1. Introduction

Welcome to www.capitalcateringplus.ae (“Website / Platform”). By accessing, browsing, or using
the Platform or availing any of the services offered by the Caterer, including placing an order
and/or making payment, you (“Client/you“) irrevocably agree to be legally bound by these Terms
and Conditions (“Terms“). If you do not accept any part of these Terms, you must discontinue use
of the Platform immediately

2. Definitions

  1. 2.1 Packaged Menus: Pre-designed catering packages for event/s and/or bulk order/s.
  2. 2.2 Itemized Menus: À la carte or individually selected takeaway/s and/or delivery order/s.
  3. 2.3 Force Majeure: Any event beyond the reasonable control of the Caterer, including but not limited to acts of God, pandemics, natural disasters, war, civil unrest, government orders or actions, and labor strikes, supply chain disruptions, or utility failures.

3. Scope of Application

These Terms apply to all orders placed via the Platform including Packaged and Itemized Menus,
as detailed below.

4. Pricing, Equipment and Service Inclusions

4.1 Packaged Menus:

  1. 4.1.1 The basic equipment (e.g., crockery, cutlery, napkins), is included and shall be provided, as specified in the quoted price/proposal.
  2. 4.1.2 Premium upgrades and services (e.g., additional serving staff, live stations, table arrangements and add ons) are available at additional cost and upon availability.
  3. 4.1.3 Delivery, logistics and/or mobilization fees are additional and may apply to offsite and in-person events and shall be reflected in the final proposal or invoice.
  4. 4.1.4 VAT is included in the package’s menu pricing.

4.2 Itemized Menus:

  1. 4.2.1 Condition Precedent: A minimum order of AED 1,000 is required to proceed with the order. Orders below this threshold are automatically void.
  2. 4.2.2 For an individual itemized menu order, you agree that no equipment (crockery, utensils) will be provided and that we shall only provide food and disposable cutlery.
  3. 4.2.3 Delivery, logistics and/or mobilization fees are additional and are location-dependent and will be specified at checkout.

5. Client Obligations

5.1 Venue and Site Access Requirements:

  1. 5.1.1 For Packaged Menus: Client must ensure uninterrupted availability of utilities such as electricity, water, waste disposal and a safe working environment at the venue. Failure to comply with the same may result in service delays or cancellation, with associated costs borne by the Client.
  2. 5.1.2 For Itemized Menus: Client must ensure accurate delivery details and timely access to our personnel. The Caterer is not responsible for delays or non-delivery due to incorrect information or restricted access. Building or community access permissions must be arranged by the Client in advance.

5.2 Regulatory Compliance:

  1. 5.2.1 Client warrants that the Client shall comply with all applicable laws and regulatory requirements of the UAE, including those governing health and safety [Abu Dhabi Agriculture and Food Safety Authority (ADAFSA)], data protection (Federal Decree-Law No. 45/2021), and consumer protection (Federal Law No. 24/2006). Any violation, including failure to obtain necessary event permits, shall be solely the responsibility of the Client.
  2. 5.2.2 Orders under AED 1,000 or suspected of fraud, false information or violation of public policy, may be auto cancelled without refund.

5.3 Authorized Representative:

  1. 5.3.1 For Packaged Menus: A designated onsite representative must be appointed by the Client to authorize service execution and changes.
  2. 5.3.2 For Itemized Menus: Complaints or issues must be raised at the time of delivery. Post-delivery disputes shall not be entertained.

6. Food Safety & Allergen Disclaimers

  1. 6.1 Consumption Window: Food should be consumed within 2 (two) hours of delivery or pickup in accordance with ADAFSA guidelines. CC+ disclaims all liability for spoilage, illness, or adverse effects arising from consumption beyond this window.
  2. 6.2 Leftovers from Packaged Menus will not be released post the event due to ADAFSA compliance obligations/restrictions.
  3. 6.3 Allergies:
    1. 6.3.1 Packaged Menus: Client must disclose all allergies clearly in the “Additional Notes” for the restaurant while ordering. While precautions are undertaken, CC+ operates in shared kitchen facilities and cannot guarantee allergen-free environments.
    2. 6.3.2 Itemized Menus: Clients should go through the item’s allergens carefully while ordering as cross-contamination risk exists despite precautions.

7. Cancellation, Refunds and Force Majeure

7.1 General Policy

  1. 7.1.1 All cancellations must be submitted through the Platform. Cancellations via email, phone, or messaging platforms (e.g., Microsoft Teams) will not be accepted.
  2. 7.1.2 The Platform cancellation option is automatically disabled 24 hours before the scheduled event or delivery.
  3. 7.1.3 The order window is 48 hours. This means orders for a specific date (e.g., 24 April) must be placed at least 48 hours in advance (i.e., by 22 April).
  4. 7.1.4 Cancellation and refund eligibility differs for Packaged Menus and Itemized Menus, as outlined below.

7.2 Packaged Menus

  1. 7.2.1 Advance Orders (≥ 7 Days Before Event):
    1. 7.2.1.1 If the event is booked 7 or more days in advance, cancellation requests made ≥ 7 days prior to the event date are eligible for a 100% refund, subject to case-by-case evaluation by Capital Catering Plus.
    2. 7.2.1.2 Capital Catering Plus reserves the right to approve or deny refunds at its sole discretion, depending on operational and cost commitments already undertaken.
  1. 7.2.2 Short-Notice Orders (< 7 Days Before Event):
    1. 7.2.2.1 If the event is booked 7 or more days in advance, cancellation requests made ≥ 7 days prior to the event date are eligible for a 100% refund, subject to case-by-case evaluation by Capital Catering Plus.
    2. 7.2.2.2 Capital Catering Plus reserves the right to approve or deny refunds at its sole discretion, depending on operational and cost commitments already undertaken.

7.3 Itemized Menus

  1. 7.3.1 ≥ 7 days before delivery: 100% refund
  2. 7.3.2 24–72 hours before delivery: 50% refund
  3. 7.3.3 ≤ 24 hours before delivery: No refund
  4. 7.3.4 Refunds for itemized orders are not automatic and remain subject to internal review for fraud prevention and quality assurance.

8. Payments

  1. 8.1 All payments must be made in advance at the time of checkout.
  2. 8.2 On-site replenishments require written approval and credit card authorization.
  3. 8.3 Prices include 5% UAE VAT unless otherwise stated. VAT adjustments will apply as per prevailing law.
  4. 8.4 Orders once placed for Itemized Menus are non-modifiable.

9. Use of the Platform

  1. 9.1 Orders must be placed at least 48 hours prior to the intended delivery date.
  2. 9.2 Clients are solely responsible for securing login credentials. Unauthorized use or fraudulent transactions are the Client’s liability.
  3. 9.3 Once digitally confirmed, orders are binding and final.

10. Equipment & Property

  1. 10.1 All equipment (for Packaged Menus) remains the property of Capital Catering Plus.
  2. 10.2 The Client is responsible for any loss, damage, or theft occurring due to their negligence or that of their guests or third-party contractors.
  3. 10.3 No equipment is provided for Itemized Menus beyond disposables.

11. Caterer’s Rights

  1. 11.1 The Caterer reserves the right to alter or discontinue any menu items or services due to:
    1. 11.1.1 Health and safety risks
    2. 11.1.2 Governmental regulations or agency directives (e.g., ADAFSA, DED)
    3. 11.1.3 Market or supply limitations
  1. 11.2 Events may be cancelled unilaterally if there is risk to public safety or violation of law. Menu items may be substituted or withheld due to availability, regulation, or operational concerns.

12. Data Privacy

  1. 12.1 All Client data is collected, stored, and processed in accordance with Federal Decree-Law No. 45/2021 (PDPL). Information collected is used solely for the purpose of service fulfilment and legal compliance. The Caterer employs industry-standard data security measures and does not sell or disclose personal data to unauthorized third parties.

13. Intellectual Property

  1. 13.1 All menus, designs, branding, website content, and proprietary material belong to CC+. Clients may not reproduce or distribute any content without prior written consent. By submitting reviews or content, Clients grant CC+ a non-exclusive, royalty-free license to use such content for marketing or promotional purposes.

14. Liability & Indemnification

  1. 14.1 Limitation of Liability: The Caterer’s liability is capped and limited to the value of the event order (Packaged Menus) and to the value of the food order (Itemized Menu).
  2. 14.1 Indemnity: The Client indemnifies CC+ and its group companies / affiliates and their respective employees, agents, directors and shareholders against claims arising from their breach of these Terms. No claims will be entertained post-consumption period (In case of itemized menu).

15. Governing Law and Jurisdiction

  1. 15.1 These Terms and any disputes arising from them will be governed by and construed in accordance with the laws of United Arab Emirates as applicable in the Emirate of Abu Dhabi. Any disputes arising from these Terms, or the auction shall be resolved through the Abu Dhabi Courts.

16. Amendments

  1. 16.1 We reserve the right to amend these Terms at any time. Any changes will be posted on our website, and continued use of the platform constitutes acceptance of the revised Terms.

17. Acceptance of Terms

  1. 17.1 Acknowledgment and Acceptance: By registering, participating and placing an order online, the client acknowledges that you have read, understood, and agree to be bound by these Terms.
  2. 17.2 Binding Agreement: These Terms constitute a binding agreement between the Client and CC+.
